• <br /> Regional Conditions <br /> • <br /> The following are regional conditions required by EPA for NWP activities that involve the discharge of <br /> dredged or fill material in tribal lands or land with exclusive federal jurisdiction. <br /> A. Regional Condition for NWP 3 - Maintenance: Any deviation from the original permitted activity's plans shall <br /> require the applicant to notify the district engineer in accordance with the "Notification" general condition at <br /> Appendix A to 33 EAR Part 330(C)(13) <br /> B. Regional Conditions for NWP 4 - Fish and Wildlife Harvesting: Commercial harvest of subtidal hardshell clams <br /> or intertidal softshell clams by means of a mechanical/hydraulic escalator type of equipment is not authorized under <br /> this NWP. <br /> C. Regional Conditions for NWP 13 - Bank Stabilization: <br /> 1. The following activities or work are not authorized under this NWP: <br /> (a) Bank stabilization projects that exceed an average of one half ( cubic yard of .uprap per running <br /> foot placed along the bank below the plane of the ordinary high watermark or the high tide line. <br /> (b) Vertical retaining walls or vertical concrete bulkheads. <br /> (c) Bank stabilization projects that exceed 500 feet in length. <br /> 2. Riprap material is to be clean angular rock or broken concrete, free of fines. Filter fabric is to be placed <br /> under the rip-rap where the surface on which the riprap will be placed is such that it will otherwise leach or <br /> erode into the water <br /> 3. The use of other non - vegetative materials for bank stabilization, such as tires, wire, and steel posts, are <br /> not authorized. <br /> 4. No equipment may be operated in the water. <br /> D. Regional Conditions for NWP 27 - Wetland Restoration Activities: <br /> 1. The discharge of dredged or fill material associated with the reversion of a restored wetland to its prior <br /> condition and use is not authorized. <br /> 2. Wetland restoration in areas falling under the designation of a federal superfund (CERCLA) or hazardous <br /> waste (RCRA) clean -up site is not authorized. <br /> 3. The discharge of dredged or fill material is not authorized in the following types of wetlands: <br /> (a) sphagnum bogs or fens <br /> (b) mature forested wetlands, i.e., wetlands with trees greater than 80 years old <br /> E. Regional Conditions for NWP 36 - Boat Ramps: <br /> 1. The ramp shall only be constructed of pre-cast concrete planks or slabs; <br /> 2. The ramp shall not exceed 12 feet in width; and • <br /> 3. Material required to stabilized the base of the ramp shall be clean upland - source stone, gravel or the like <br /> and shall not exceed a maximum of 20 cubic yards. <br /> 4. Boat ramps are not authorized under this NWP in special aquatic sites as defined at 40 CFR Part 230 <br /> Subpart E or smelt spawning beaches or eelgrass beds. <br /> 5. Only one boat ramp is authorized under this NWP per contiguous property ownership. <br /> F. Regional Condition for NWP 38 - Cleanup of Hazardous and Toxic Waste: This NWP shall only apply to <br /> cleanup activities authorized by the U.S. Environmental Protection Agency. Interagency coordination shall be <br /> provided in accordance with the "Notification" general condition in Appendix A to Part 330(CX13). <br /> 14 <br />
