5. NWPs do not authorize interference with any existing or proposed federal project. <br /> 6. The Oregon Coastal Zone is the area lying between the Washington border on the north to the California border <br /> on the south, bound on the west by the extent of the state's jurisdiction, and on the east by the crest of the Coastal <br /> Mountain Range, with the exception of (a) the Umpqua River basin, where the coastal zone shall extend to <br /> Scottsburg; (b) the Rogue River basin, where the coastal zone shall extend to Agness; and (c) the Columbia River <br /> basin, where the coastal zone shall extend to the downstream end of Puget Island. <br /> 7. NWP general condition 11 (Endangered Species) and 13 (Notification), require non - federal permittees to consider <br /> federally listed endangered and threatened species (see "General Conditions" on pages 11 through 13). NWP 4 does not authorize construction of net pens or other structures for the purpose of aquaculture activities. <br /> 9. NWPs 3, 13, 27, 36, and 38 have water quality certification imposed regional conditions for activities that would <br /> occur on tribal land or land with exclusive federal jurisdiction. If the proposed activity meets the terms of the NWP <br /> as defined in the regulations at 33 Celt 330 Appendix A but does not conform to the regional conditions, water <br /> quality certification is considered denied for the activity, and the NWP is not valid. <br /> 10. Following each NWP described below, there is, in parentheses, a reference to the statuatory authority under <br /> which the NWP is authorized. For example, NWP 1 authorizes work pursuant to Section 10 of the River and <br /> Harbor Act. It does not authorize the discharge of fill or dredged material in waters of the United States which <br /> would require authorization under Section 404 of the Clean Water Act. <br /> Nationwide Permit Descriptions <br /> 1. Aids to Navigation. The placement of aids to navigation and regulatory markers which are approved by and <br /> installed in accordance with the requirements of the U.S. Coast Guard. Structures constructed in artificial canals within principally residential <br /> developments where the connection of the canal to a navigable water of the United States has been previously <br /> authorized (see 33 CFR 322.5(g)). The repair, rehabilitation, or replacement of any previously authorized, currently serviceable, <br /> structure or fill, or of any currently serviceable structure or fill authorized by 33 CFR 330.3, provided that the <br /> structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original <br /> permit or the most recently authorized modification. Minor deviations in the structure's configuration or filled area <br /> including those due to changes in materials, construction techniques, or current construction codes or safety <br /> standards which are necessary to make repair, rehabilitation, or replacement are permitted, provided the <br /> environmental impacts resulting from such repair, rehabilitation, or replacement are minimal.
