• <br /> ADMINISTRATIVE ORDER NO. 58- 95 -19 -F <br /> of the <br /> CITY MANAGER PRO TEM <br /> STORMWATER SYSTEM <br /> ADMINISTRATIVE RULE <br /> The City Manager Pro Tem of the City of Eugene finds that: <br /> A. Pursuant to the authority contained in Section 2.019 and Chapter 6 of the Eugene <br /> Code, 1971, on May 3, 1996 I adopted Administrative Order No. 58 -95 -19 proposing the <br /> adoption of a Stormwater System Administrative Rule to establish procedures for an enforcement <br /> program designed to discourage violations of the Eugene Code, 1971 relating to improper <br /> connections and /or illegal discharges to the City's stormwater system, and/or violations of the <br /> City's NPDES stormwater permit and Comprehensive Stormwater Management Plan (CSWMP). <br /> The rule provides a formula for computing the amount of administrative civil penalties, sets forth <br /> enforcement remedies, and provides for the manner in which decisions may be appealed. <br /> B. Notice of the proposed adoption of the Stormwater System Administrative Rule was <br /> published in the Register Guard, a newspaper of general circulation within the City for five <br /> consecutive days, to -wit, on May 12, 13, 14, 15, and 16, 1996. The Notice was also made <br /> available to persons who had requested notice, and made available for inspection by interested <br /> persons at the City's Public Works Department, Administration Division, 858 Pearl Street, <br /> Eugene, Oregon 97401 during normal business hours (9:00 a.m. to 5:00 p.m., Monday through <br /> Friday, exclusive of holidays). <br /> C. The Notice provided that written comments would be received thereon for a period <br /> of 15 days from the first date of publication. Written comments were received from The Schnitzer <br /> Group, Rexius Forest By- Products, Inc., and Bulk Handling Systems, Inc., to which I make the <br /> following fmdings: <br /> Comment 1: The proposed rule is redundant and unnecessary due to existing state <br /> and federal regulation of surface water quality and stormwater discharges. <br /> Finding: As a condition of the City's National Pollution Discharge Elimination <br /> System (NPDES) permit, the City is required to implement legal and effective mechanisms <br /> to control the quality of the stormwater it is discharging. Although the Department of <br /> Environmental Quality (DEQ) issues NPDES stormwater discharge permits, relatively few <br /> businesses operating within the City are required to obtain a NPDES permit, and <br /> residential violations are not subject to permit requirements. The majority of the City's <br /> businesses and residents are subject to regulation through provisions of the Eugene Code, <br /> 1971 (EC).
