• <br /> /6/59 <br /> 3o County shall, at its own expense acquire grant easements or <br /> convey to District all property necessary for the improvement of Patterson <br /> Slough from the westerly end of the state project, as shown on the attached <br /> Exhibit "A" at approximately relocated "Q« Street Engineer's center line <br /> Station QL 64 westerly to the confluence of Patterson Slough and the <br /> Willamette River. <br /> 4. 'County shall widen, clear and improve said Patterson Slough <br /> . between the above - Mentioned points in order to increase the capacity there- <br /> of and to accommodate the discharge of water from the said floodways to be <br /> constructed by State and County and maintained by District under the terns <br /> and provisions of this agreement, <br /> 5. County shall, whenever necessary, and at its own expense <br /> build, revise and maintain all county structures carrying county roads <br /> over the floodways as listed hereinafter so that said structures can <br /> properly accommodate the discharge of water from all the said floodways. <br /> Floodway Aa • <br /> a 8 x 4' box culvert through Harlow Road. <br /> Floodway Bo <br /> a. Triple 9 x 7 box culvert at Garden Way. <br /> b. Structure at Patterson Slough Road. <br /> c. Structure at Day Island Road. • <br /> 6. County shall join with District in the establishment of a <br /> flood control project in cooperation with the U. S. Soil Conservation <br /> Service, which is to include, but not be restricted to floodways along <br /> the southerly side of ' Street easterly from the West right of way line <br /> . of Mill Street and the constriction of a dike adjacent to the said McKenzie <br /> River along the "High Bank Road" yr, order to prevent floodwaters from the <br /> McKenzie River r - from flowing over its natural bank and westerly and southerly <br /> through the project. <br /> . 7. In the event such project of County, District and the U. S. <br /> Soil Conservator. Service as set forth in paragraph 6 under THINGS TO BE <br /> DONE BY COUNTY is not authorized by the U. S. Government and funds are not <br /> available from the Federal Government enabling construction of a dike on <br /> the "High Bank Road " approximately in the location shown on the map marked <br /> •"Exhibit A" attached hereto and by this reference made a part hereof, to <br /> begin by September 1,, 1959 lane County agrees to construct with its own <br /> funds or with funds from other sources, at the option of County, the said <br /> dike in accordance with plans prepared by the U. S. Soil Conservation <br /> Service. County shall finish said construction so that said dike will be <br /> —4— <br />
