J ' <br /> following criteria: <br /> (a) The applicant has provided evidence that the piping or filling was specifically <br /> authorized by an approval that was final at the local level prior to May 24, 2000; <br /> (b) The proposed plan meets the following mitigation requirements: <br /> (1) The applicant's mitigation plan includes a description of existing <br /> waterway hydrological, ecological, and water quality treatment functions within the <br /> area to be impacted, demonstrates how impacts to those functions are minimized, and <br /> demonstrates that the proposal will not result in a net loss of these functions due to <br /> the proposed activity; <br /> (2) The mitigation plan includes a map showing the location and area of <br /> proposed mitigation, along with supporting cross- section, elevations, and diagrams <br /> of the finished grade and proposed plantings (species, number, location), and a plan <br /> for monitoring and ensuring the success of the mitigation plan that includes suitable <br /> financial guarantee to pay for unanticipated construction impacts and to assure <br /> mitigation is completed, and documents that guarantee long -term protection of <br /> mitigation sites (i.e., recorded easements and restrictive covenants). <br /> (3) Analysis and supporting documentation shall be provided by an <br /> Oregon - certified professional engineer (for providing analysis and documentation <br /> concerning drainage and flood control), and/or an environmental professional (for <br /> providing analysis and documentation about riparian and wetland areas, wildlife <br /> habitat, filtering and settling pollutants, or preventing erosion). Environmental <br /> professionals shall demonstrate experience with natural stream systems and habitat <br /> restoration. <br /> (4) s If it is not possible to mitigate for negative impacts to the waterway <br /> on the same site, an applicant may propose to mitigate on a nearby site within the <br /> same waterway corridor as the impacts, or may make a payment to the mitigation <br /> fund at the rates and in the manner described in R- 6.650 -J. <br /> 3. Decision. The City Manager shall review the application and issue a decision thereon <br /> in the manner provided in R- 6.650 -I. <br /> R 6.650 - F Open Waterways - Uses or Activities in an Open Waterway (EC 6.660(2)). <br /> 1. Application. The owner of the property or permittee requesting approval of an <br /> exemption under EC Section 6.660(2) shall submit an application to the City Manager on a form <br /> prescribed by the City Manager for approval of the exemption.
