R 6.650 -B Definitions. <br /> • <br /> As used in this Rule, the following words and phrases mean: <br /> Environmental Professional A botanist, biologist, wetland consultant, geotechnical <br /> specialist, landscape architect, stream morphologist, or other person with demonstrated <br /> experience with natural stream systems and habitat restoration. <br /> Final at the Local Level. A land use approval is "final at the local level" if (a) the <br /> Planning Director or Hearings Official approval has not been appealed and the time for filing <br /> an appeal has expired; or (b) if appealed, the local appellate body has issued a decision. For <br /> Subdivisions, Partitions, and PUDs, the application is final at tentative approval. <br /> Minimization of Impacts. To demonstrate that the proposed facility or action is <br /> designed and located to result in the least amount of both short-term and long -term • <br /> disturbances to hydrological, ecological, and water quality treatment functions in the <br /> waterway. <br /> Mitigation of Impacts. To rectify the impact by repairing, rehabilitating, or restoring <br /> the affected environment, or compensating for the impact by replacing or providing substitute <br /> resources or environments, ensuring no net loss of hydrological, ecological, and water quality <br /> treatment functions in the waterway. <br /> Open Waterway. A natural or human-made swale, creek, stream, open channel, <br /> ditch or other similar water feature, that has a defined and identifiable channel with slopes, <br /> • <br /> that is predominantly of earthen material, and that has the specific function of conveying <br /> and/or storing stormwater runoff. An open waterway does not include isolated ponds or <br /> other water features that are not connected to the surface water system (i.e., have no inflow <br /> or outflow) so long as the isolation was not created illegally. <br /> R 6.650 - C Open Waterways - Permit Approval Required. <br /> Except as provided in subsection (1) of Section 6.660 of the Eugene Code, 1971 (EC) and <br /> R- 6.650 -E: <br /> (a) No person shall place foreign materials in or over the channel of an open <br /> waterway without the prior written approval of the City Manager. <br /> (b) No construction shall take place in or over an open waterway channel without <br /> the prior written approval of the City Manager. <br /> • <br /> Administrative Order - 2 r , ora\rwes\oft ., osios/oo) <br /> • <br />
