a <br /> Recommendation. Pursue assumption of the State's program. <br /> 5. Applicability- Effective Date. When do the provisions go into effect? <br /> Response. The City intends to have the local program in place prior to next construction <br /> season. The estimated effective date is April 1, 1996. <br /> 6. Who Can Prepare Erosion Control and Construction Site Management Practices <br /> Plans? There were questions as to who would be authorized to prepare the Erosion <br /> Control and Construction Site Management Practices plans. <br /> Response. The City's goal is to have the most qualified people prepare these maps. The <br /> draft recommendations seek to allow a greater range of qualified professions than the <br /> current DEQ requirements (civil engineers only) for sites greater than five acres in size. <br /> The City will negotiate these allowances as part of the MOA discussions. For areas <br /> where the State has no jurisdiction (sites five acres in size or less), the draft <br /> recommendations require plans to be prepared for sensitive areas only. In these cases, the <br /> City will allow the plans to be prepared by civil engineers, architects, landscape <br /> architects, and individuals certified as a professional in Erosion and Sedimentation <br /> Control. For single family construction, the plans can be prepared by any individual using <br /> a template established by the City. <br /> Recommendation. Pursue negotiations with DEQ to allow a greater range of professional <br /> who can prepare plans. <br /> 7. Responsible Party. The question was who is responsible for the erosion control <br /> performance if all of the facilities are designed to City standards and they still fail? <br /> Response. The City's first step would be to determine the cause of failure. If it was due <br /> to faulty construction or maintenance, the property owner would be responsible for <br /> correcting the problem. If it was due to faulty design parameters set by the City, the <br /> City's would adjust the standards to prevent future problems. Under the second scenario, <br /> the City would not be in a position to take enforcement actions against the property <br /> owner. <br /> Recommendation. No changes are recommended. <br /> 8. Existing Platted Subdivision. How will the standards apply to existing platted <br /> residential subdivisions? <br /> Response. For single family residential lots within sensitive areas, a stormwater permit is <br /> required. The required Erosion Control and Construction Site Management plan may be <br /> 9 <br /> • <br />
