This 1 • • • Ing PW <br /> can occur because of a loophole in city regulations. Logging this parcel Is contrary top. - <br /> policy statements within the following documents: <br /> LCDC Goals & Senate Bill 100 (specifically Goal V; and ESE Studies <br /> South Hills Study <br /> Metropolitan Natural Resources Speclal Study <br /> Metro -Area General Plan, Environmental Resources Element Section I/1-C-9 Pollcles 014 & 4E18 <br /> These documents clearly address the necessity for regutafing tree cuffing In the urban growth <br /> boundary with regard to the scenic quality. water quality, riparian. wildlife, vegetation. and <br /> open space values of the land. <br /> ,. <br /> Desptte the dear intent of public policy, under Current procedures City Staff must issue <br /> tree cutting permits, if the stated intent of the applicant is for timber harvesting and does not <br /> Include development, even when the Lands In question have baen zoned to comply with PUD <br /> procedure. As a resutt, logging these areas within the Urban Growth Boundary is governed only <br /> by the Oregon Forestry Practices Act which allows clear cutting and road building in obvious <br /> violation of LCDC Goals, the Metro-Area Plan, and PUD regulations. <br /> Cry of Eugene Municipal Code, Planned Unit Development Section 9.259 states 'The <br /> development of land within the city shall be accomplished In accordance with Planned Unit <br /> Development regulations, Site Review procedure, or Conditional Use Permit procedure <br /> whenever required by the provisions of the General Plan and refinements thereof, <br /> development map or any other appticabie plan adopted by the city. <br /> Therefore we urge the City Council to take Immediate action and require City staff to <br /> comply with the current land use laws and the language of our planning policies. We believe <br /> this can be accomplished through The application of the Municipal Code to require that all <br /> lands within the Urban Growth. Boundary be subject to PUD review prior to the issuance of <br /> logging permits i regardless of the Intent 01 the dppllcants.
