As I understand it, this occurred <br /> without our involvement due to the removals being approved at the PIC as part of a demolition permit. <br /> Therefore I think the staff who performed the approvals at the PIC need to handle this one. <br /> We could certainly write a memo telling Council that we weren't involved and what we have learned <br /> second hand, but I don't believe that is appropriate. I also think the Council could get us into one part of <br /> the organization seeming to point fingers at another part. We can't answer any of the likely follow -up <br /> questions of such as why the trees needed to be removed or what evaluation was done. Our office is <br /> interpreting the code that having a "building" permit for a "dwelling" exempts removals from the Tree <br /> Preservation Ordinance. The justification for this interpretation is that having an approved building permit <br /> shows a clear intent to "construct" the dwelling which requires the removal of the trees in order to allow <br /> that construction. Following are the result <br /> of my investigation. <br /> 1. Most of the trees were identified for removal as part of <br /> the demolition plan /permit. The approved demolition plans <br /> identified most of the trees to be removed with the <br /> preservation of a few. The demolition plan specified <br /> compaction, fill for the site and removal of the trees. <br /> 2. Later, given the compaction and fill of the site, the <br /> applicant requested the removal of the remaining trees since <br /> they weren't expected to survive.
