If these <br /> trees are part of a "public" program then we have the <br /> liabilities /complaints to consider. With the code currently <br /> not allowing fruit trees in the r /w, Council action would be <br /> required to make this policy change. <br /> Fruit trees in a park would also have a "dropping" problem but <br /> the liabilities would not compare. In the highly developed <br /> parks some additional maintenance would need be provided to do <br /> this clean -up. I suspect we could find some locations where <br /> dropping wouldn't be that much of a concern, but in these <br /> locations we likely would have to do a few infrastructure <br /> improvements for an orchard (i.e. provide irrigation). <br /> Fruit bearing trees take additional care over that of the <br /> typical street or park trees in order to bear good fruit. The <br /> major question is how we insure that care is to be provided? <br /> Where does the resource come from? Volunteers? Staff?
