I agree tentative subdivision approval
meets the criteria for permit exemption for trees to be removed on right -of -way. That has been our past
practices on this type of issue.
Scott will fill out the tree removal permit application form for the 5 trees on the Chambers parcel. If Jeff
Lankston will provide us a drawing showing the location of the 5 trees on the Chambers parcel in
relationship to the construction project, we can then forward the total package to you. Once you obtain a
signature from a representative of Chambers we can then issue the permit.
(Jeff, can you get Scott the above drawing ?)
I believe the above will take care of all the TECHNICAL issues involving the tree removals. I haven't been
in the loop about what kind of a public notification process you are going to use. Since the tree code
doesn't require such notice in this case, my staff don't need to be involved unless you wish us to be.
Cathy, sorry for the last minute flurry of technical details needing to be covered. However, I hope you
agree that it is our best interest to cover all the possible problems early on. Things must be moving pretty
quickly or I suspect we would have been brought into the process sooner. I hope everything goes well for
you in this project.
Thanks
Johnny
From: BRINER Cathy A
To: LANKSTON Jeff; WILEY Diane K (UO)
Cc: MEDLIN Johnny R; PLAMONDON Scott F
Subject: FAX
Date: Thursday, June 19, 1997 3:35PM
Priority: High
I am faxing you both copies of the tentative subivision approval.
I talked to Jim Croteau about whether or not the trees to be
removed can be considered to be in the right -of -way. It is
his determination that, because the trees are located in a
designated right -of -way as part of a subdivision process that
has been tentatively approved, they can therefore be
considered right -of -way trees & be removed without a permit. I
also double- checked a city attorney opinion I got on the SPRR
trees - -city attorney determined that trees in right of way or
needing to be felled for a road improvement were not subject
to the tree felling permit.
I am hopeful that this is the end of this matter.CB
Page 1
