In particular, the severe disciplinary action? I would appreciate it, if you feel based on
what you now know, you can do that and send a cc to Chris. If you don't I'd like your advice on what
severe disciplinary action is warranted. Scott informed
me that after he left the site yesterday, another historic
tree (Chestnut) was severely damaged by the contractor in the
presence of inspector Bud DeSantis. Scott said he was very
clear with Engineering staff after the damage occurred to the
first historic tree.
I consider this a completely unacceptable action. Scott had
agreement with Engineering staff that no work would occur
around this historic Chestnut tree unless he was present, yet
after he left Bud allowed severe damage to occur to this tree.
Scott also had agreement with the property owner that he
would be on site during work around this tree.
In addition, a tree planted by the NeighborWoods Program had
the roots ripped off one side of it. This is a tree planted,
watered, and nurtured by the abutting property owner.
What is really disturbing about this is that this damage
occurred after Scott felt he had agreement that adequate tree
protection methods would occur. He has had 4 - 5 meetings
during the course of design of this project with Engineering
staff emphasizing the extreme importance of historic trees.
He has also pointed out to Engineering staff the charter
requirements to not remove historic trees without a vote for
street widening projects.
When the private arborist came to the site and saw the first
damaged tree his reaction was "oh my god, this tree has to
come out ". Scott concurs that so much damage has occurred to
this tree it now presents a hazard.
Scott is getting calls from people upset about tree damage
occurring on the project. I told him to refer them to
Engineering staff as I feel he has done everything but stand
directly in front of the equipment to try to protect the
trees. Bud's perception is that the street project is going
to get done somehow and doesn't seem to give a rip about the
trees. As far as I am concerned you need to take severe
disciplinary action as this is a failure to do his job. I
understand he was over at the Green Street meeting later in
Page 1
