Their understand on this (which I don't at all <br /> contest) is that the City would allow the removal with the only remaining issue being the one of how they <br /> mitigated for the loss of the street trees. They felt the resolution of that issue was "pending" and awaiting <br /> a response from the City to their letter to the City Manager. In other words, they felt the ball was in our <br /> court" and that we wouldn't hang up their project while it was being resolved. I don't think this is an <br /> unreasonable assumption, but I wish we and they had been clearer on getting something in writing passed <br /> between us that said this. <br /> As you can see from Scott's note immediately below, they are now requested to remove additional street <br /> trees. The value of the trees that they are planting "on site" is given below and it is greater than the value <br /> of the street trees removed. Whether or not the value of on site trees mitigate dollar for dollar that of <br /> street trees lost is a policy issue and one in which I will await direction from you. <br /> As you suggested, perhaps our best course of action at this point would be for your office to contact that <br /> of the LTD General Manager and see where we want to go from here. I believe we need some outcome <br /> which results in our issuing a formal permit for the trees removed or to be removed. <br /> There is a small permit fee for that action and if we end up having to write an agreement, I would hope we <br /> could append that cost onto the permit fees. I realize I'm a little hung up on the issue of fees, but due to <br /> funding limitations in both the General Fund and the Road Fund, I see generating fees to cover the cost of <br /> doing business as the only way we are going to ever be able to justify the additional staff needed to start <br /> getting us out of a "crisis mode" in processing "tree issues" dealing with the impacts of development on <br /> private property. <br /> I will await your instructions. <br /> Thanks <br /> Johnny <br /> From: PLAMONDON Scott F <br /> To: MEDLIN Johnny R <br /> Subject: FW: LTD Trees <br /> Date: Tuesday, March 18, 1997 12:19PM <br /> Johnny, Here is the copy of previous memo's on the removal of the street trees for the LTD project at <br /> 10th and Olive.
