ADMINISTRATIVE ORDER NO. 58- 04 -03 -F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF TREE REMOVAL AND STREET TREE <br /> PLANTING PROGRAM FEE SCHEDULE; RATIFICATION <br /> OF UNAMENDED FEES; AND REPEAL OF <br /> ADMINISTRATIVE ORDER NO. 58-00-02-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Pursuant to the provisions of Sections 2.020, 6.330 and 7.280 of the Eugene Code, <br /> 1971, on March 30, 2000, Administrative Order No. 58- 00 -02 -F was issued establishing the Tree <br /> Removal and Street Tree Planting Program Fee Schedule as set forth in Exhibit A thereto. <br /> B. On February 16, 2004, in accordance with the provisions of Sections 2.020, 6.330, <br /> and 7.280 of the Eugene Code, 1971, I issued Administrative Order No. 58 -04 -03 and notified the <br /> Mayor and City Councilors that I intended to amend the City's Tree Removal and Street Tree <br /> Planting Program Fee Schedule as set forth in Exhibit A attached thereto. <br /> C. Notice was also posted at two locations at City Hall and published in the Register <br /> Guard, a newspaper of general circulation within the City, on February 20, 2004, and was made <br /> available for inspection by interested persons at the Public Works Department, 1820 Roosevelt <br /> Blvd., Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., Monday <br /> through Friday, exclusive of holidays). The Notice provided that written comments would be <br /> received for a period of 15 days from the date of publication. No written comments were received <br /> within the time or in the manner provided in the Notice. <br /> D. I find that the revisions to the Tree Removal and Street Tree Planting Program Fee <br /> Schedule are necessary for the fee schedule to be consistent with recent amendments to the City's <br /> Street Tree Program Administrative Rule R -7.280 and should be amended as set forth in Exhibit A <br /> hereto. In determining the fees, I have considered the applicable policies, enactments and directives <br /> of the City Council, the amount charged for these services by the City in the past, the full costs of <br /> providing these services supported by the fees, the amounts charged by other comparable providers, <br /> and the revenue needs of the City as determined by the adopted City budget. <br /> On the basis of these findings, I order that: <br /> 1.
