ADMINISTRATIVE ORDER NO. 58-04-02-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF STREET TREE PROGRAM <br /> ADMINISTRATIVE RULE R -7.280 AND REPEAL <br /> OF ADMINISTRATIVE ORDER NO. 58-96-23-F. <br /> The City Manager of the City of Eugene finds that: <br /> • <br /> A. Pursuant to the authority of Section 2.019 of the Eugene Code, 1971, <br /> Administrative Order No. 58- 96 -23 -F was issued on February 28, 1997 adopting Street Tree <br /> Program Administrative Rule R- 7.280. <br /> B. Based on the findings contained in Administrative Order No. 58 -04 -02 issued on <br /> January 29, 2004, I proposed to amend Street Tree Program Administrative Rule R -7.280 as set <br /> forth in Finding C of that Order. <br /> C. Notice of the proposed amendments to Street Tree Program Administrative Rule <br /> R -7.280 was given by making copies thereof available to any person who had requested such <br /> notice and by publication thereof in the Register Guard, a newspaper of general circulation <br /> within the City for at least five consecutive days, to -wit, on February 3, 4, 5, 6, and 7, 2004, <br /> providing interested persons an opportunity of not less than 15 days to submit data or comments <br /> thereon. No comments were received within the time and in the manner required by the notice. <br /> Now, therefore, based upon the above findings, the findings in Administrative Order No. <br /> 58- 04 -02, and pursuant to the authority of Section 2.019 of the Eugene Code, 1971, I hereby <br /> repeal Administrative Order No. 58- 96 -23 -F, as of the effective date of this Order, amend Street <br /> Tree Program Administrative Rule R -7.280 as proposed in Administrative Order No. 58- 04 -02, <br /> and ratify and affirm the unamended portions thereof so that R -7.280 provides in its entirety as <br /> follows: <br /> STREET TREE PROGRAM <br /> ADMINISTRATIVE RULE R -7.280 <br /> R- 7.280 -A Street Tree Program - Policy. <br /> In order to create attractive and healthy neighborhood environments, no approval shall be <br /> granted for a development that involves the creation of a street unless the applicant has submitted <br /> and received approval of a Street Tree Plan pursuant to R- 7.280 -C.1 or executed an agreement <br /> with the City pursuant to R- 7.280 -C.2 that ensures street trees will be planted and established in <br /> accordance with the standards and procedures provided for in these rules and the adopted <br /> policies of the Urban Forest Management Plan. Street trees shall be planted as each lot or area is <br /> developed and shall be required on that portion of street right -of -way that abut lots within the <br /> development as well as on new streets within the development site. <br /> Administrative Order - 1 <br />
