CITY OF EUGENE <br /> INTER - DEPARTMENTAL MEMORANDUM <br /> CITY ATTORNEY - CIVIL DEPARTMENT • <br /> To: Lauren ouinard Date: January 13, 1993 <br /> AS , RRS <br /> Subject: Fallen Tree at 2641 E. Wilshire, Eugene, OR <br /> This will confirm our telephone conversation on January 12, 1993, and follows my <br /> conversation with Bob Hammitt on January 11. <br /> We have received reports that some individuals may assert claims against the City for <br /> damages they sustained as a result of the tree that collapsed at 2641 E. Wilshire earlier this <br /> month. As we discussed, based upon our preliminary review of the matter, we see no <br /> conceivable circumstance under which the City or any of its agents or employees could be <br /> held liable for the accident in question. Nevertheless, based upon the suggestion that claims <br /> may be asserted, I request that the City conduct an investigation into the circumstances <br /> surrounding the collapse of the tree. <br /> In particular, please determine, based upon the condition of the tree and other <br /> circumstances, the cause of the collapse. Also, please document any activity by any City <br /> employee or agent regarding the tree within the last twelve months. <br /> Thank you for your cooperation.
