Section 7.990 of the Eugene Code, 1971, is hereby amended, and a new <br /> Section 7.995 added thereto, to provide: <br /> 7.990 Penalties - [Specific] General. Violation of any section in this chapter is <br /> punishable by fine not to exceed $500.00. <br /> 7.995 Penalties - Specific. <br /> (1) Violation of section 7.665 to and including section 7.670 is punishable <br /> by a fine of a minimum of $100.00 to a maximum of $4,000.000 for each tree removed, or <br /> confinement in jail not to exceed 100 :. days, or both fine and imprisonment. In addition, the <br /> city attorney, upon request of the city:. manager, shall institute any necessary legal <br /> proceedings to enforce the provisions of sections 7.665and 7.670 of this code. <br /> (2) In addition to any penalty that may be imposed under subsection (1) <br /> of this section , -a personr wilfully violates subsection 7.665(2) may be required to pay <br /> to the city a sum equal to the value of the felled heritage tree, which shall be calculated <br /> using the methods set forth in the edition then in effect of the Guide for Plant Appraisal <br /> published by the International Society of Arboriculture Council of Tree.
