C • <br /> .he proposed tree felling is the minimui. -tcessary to allow the <br /> approved development or; <br /> (b) If the felling is being requested under section 6.317(4)(b), a tree <br /> hazard report prepared by an arborist certified by the <br /> International Society Arboricultural or a landscape architect <br /> licensed in the state of Oregon, or a licensed or certified <br /> professional from a n equivalent profession approved by the city, <br /> which certifies that the felling is necessary to protect adjacent <br /> trees from disease or to eliminate a hazardous or unsafe <br /> condition. <br /> Home Builders Association of Lane County comments to (2) (a)(b): <br /> It is an unacceptable practice to assume that Arborists (or other certified <br /> professionals) will assume the liability and subjects the Arborist (or other certified <br /> professional) to the possibility of a civil lawsuit. <br /> (2) The application shall be accompanied by an application fee in an <br /> amount established by the city manager pursuant to section 2.020 of <br /> this code. <br /> Home Builders Association of Lane County comments to the above (2): <br /> What is stopping the city from setting these fees at the time of adoption? A fee <br /> schedule should be created prior to adoption of this ordinance. This has the potential <br /> for creating a barrier to affordable housing. <br /> (3) The city manager or designee shall act on the permit application <br /> within ten business days of receiving a completed application. <br /> (4) All trees permitted to be removed shall be posted with an 8 "x 11" <br /> notice, in a format approved by the city, which lists the name and <br /> telephone number of the applicant, the reason for the removal, the <br /> permit number, and the date on which the permit was issued. The <br /> posting shall occur a minimum of seven calendar days before felling. <br /> For permits issued under 6.315(4)(a), the posting shall remain until <br /> such time as the stump is removed or the approved development is <br /> completed. For permits issued under section 6.315(4)(b), the posting <br /> period may be reduced or eliminated if an immediate hazard is <br /> certified to exist. <br /> Home Builders Association of Lane County comments to the above (3)(4): <br /> The posting should be required prior to the issuance of any permit(s) under both <br /> sections 6.315(4)(a) and 6.315(4)(b). When defining permit, the city should recognize <br /> that it is "permitting" the tree removal. We would recommend posting and then a <br /> permit issued within ten business days. <br />
