• <br /> NOTICE OF INTENDED RULEMAKING <br /> PROPOSED AMENDMENTS TO AND RENAMING OF TREE <br /> PRESERVATION ADMINISTRATIVE RULE R- 6.305. <br /> NOTICE IS HEREBY GIVEN that pursuant to the authority contained in Section 2.019 <br /> of the Eugene Code, 1971, the City Manager of the City of Eugene intends to amend and rename <br /> Tree Preservation Administrative Rule R -6.305 as follows: <br /> To rename the rule Tree Removal Permit Program; amend the definitions of <br /> dwelling, fell, and tree; add new definitions of correct, critical root zone, diameter <br /> breast height (dbh), enforcement action, enforcement officer, hinder, illegal felling, <br /> intentional, negligence, notice of violation, notice to correct, protected natural <br /> resource area, responsible person, unavoidable accident, and violation; add an <br /> Applicability section; correct references and amend and reletter the Permit <br /> Requirements section, Application Procedure section, Criteria for Permit Approval <br /> section, and Permit Issuance section; add new sections on Enforcement and <br /> Determination of Civil Penalty amounts; amend the Appeal section, and reletter the <br /> Exceptions provision to more accurately reflect administrative practices, and <br /> establish a matrix for computation of the administrative civil penalty. <br /> The proposed amendments are consistent with provisions of the Eugene Code, 1971, and are <br /> intended to clarify and identify the activities regulated by the Rules. The existing rules and this <br /> proposed amendments may be reviewed at the Public Works Department, 1820 Roosevelt Blvd., <br /> Eugene, Oregon 97402 during normal business hours (8:00 a.m. to 5:00 p.m. Monday through <br /> Friday, exclusive of holidays). <br /> All persons wishing to comment thereon or object thereto must submit their comments or <br /> objections to the Urban Forester, 1820 Roosevelt Blvd., Eugene, Oregon 97402, in writing, within <br /> thirty (30) days of the date of the first publication hereof, as indicated below. The City Manager will <br /> thereafter adopt the amendments to Tree Preservation Administrative Rule R -6.305 as proposed, or <br /> as amended in response to comments received. <br /> JAMES R.
