1. The value of the real property; and <br /> 2. The costs incurred by the city in the construction of public <br /> improvements. <br /> (b) Notice of the proposed assessment for benefits shall be given by mail to <br /> the owners of the property to be assessed no less than 20 days prior to the <br /> public hearing of the vacation application before the city council <br /> consistent with the public hearing notice procedures prescribed in EC <br /> 9.7400 General Overview of Type IV Application Procedures. <br /> (c) The notice shall contain a statement of the names, addresses, and the <br /> amount of the proposed assessment of each land owner's special benefit by <br /> the vacation and the hour, date, and place of the public hearing at which <br /> the city council will hear objections to the vacation or assessment. <br /> (d) At least 5 working days prior to the public hearing, the land owner shall <br /> deposit with the city the sum of money called for by this subsection (4). <br /> (e) If the vacation application is approved by the city council, the deposit shall <br /> be retained by the city as directed by the city council. If the vacation <br /> application is denied by the city council, the deposit shall be returned to <br /> the land owner. <br /> (5) For vacations under the Type I or Type 11 process, the application must include <br /> the signatures of all owners of the property subject to the easement and the <br /> owners of abutting properties. <br /> 9.8715 Approval Criteria for the Vacation of an Unimproved Easement. The planning <br /> director shall approve, approve with conditions, or deny the vacation application. <br /> Approval, or approval with conditions shall be based on all of the following: <br /> (1) The subject area is not presently or in the future needed for public services, <br /> facilities, or utilities, and the vacation does not prevent the extension of, or the <br /> retention of public services, facilities, or utilities; or if needed, the applicant <br /> shall provide for the replacement and abandonment of any existing public <br /> services, facilities or utilities in the subject area. <br /> (2) Such public services, facilities, or utilities can be extended in an orderly and <br /> efficient manner in an alternate location. <br /> 9.8720 Approval Criteria for Vacation of Improved Easements, Unimproved Public <br /> Right -of -Way, and Vacation and Rededication of Unimproved Public Right -of- <br /> Way. The planning director shall approve, approve with conditions, or deny the <br /> vacation application.
