ORDINANCE NO. 20225 4 <br /> AN ORDINANCE CONCERNING TREE REMOVAL AND <br /> REPLACEMENT; AMENDING SECTIONS 6.300, 6.305, 6.320, <br /> 6.325, 6.330, AND 6.990 OF THE EUGENE CODE, 1971; <br /> AMENDING AND RENUMBERING SECTION 6.310 OF THAT <br /> CODE TO 6.315; ADDING NEW SECTIONS 6.302, 6.304, 6.310 <br /> AND 6335 TO THAT CODE; AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> Section 1. The following caption and Sections 6.300, 6.305, 6.320, 6.325, and 6.330, of the <br /> Eugene Code, 1971, are amended; the current Section 6.310 is renumbered 6.315 and amended; and <br /> new Sections 6.302, 6.304, 6.310 and 6.335 are added, to provide: <br /> Tree Removal and Replacement <br /> 6.300 Tree Removal and Replacement - Definitions. As used in section 6.302 to 6.335 of <br /> this code, the following definitions apply: <br /> Arborist, certified. A person certified by the International Society of <br /> Arboriculture as having specialized knowledge, experience and training related to <br /> arboriculture, including, but not limited to, knowledge of best management practices <br /> for tree pruning and maintenance, construction impacts to trees, tree pests and <br /> diseases, and hazardous tree evaluation. <br /> Construction activity. An activity used in the process of developing, <br /> redeveloping, enhancing or maintaining land that removes existing vegetation cover <br /> or disturbs the earth's surface, including, but not limited to: clearing, grading, filling, <br /> excavation, paving, harvesting, boring, drilling or trenching. <br /> Critical root zone. That area surrounding a tree that: <br /> (a) Has a radius of 18 inches times the diameter breast height <br /> expressed in inches of the tree trunk or trunks; or <br /> (b) Encompasses an area determined for an individual tree to be <br /> the necessary root area for the tree's continued normal growth as <br /> demonstrated in a written report by a certified arborist and based on <br /> documented field investigation and non - destructive physical testing, <br /> including, but not limited to non - destructive excavation to delineate the root <br /> system to a minimum depth of 24 inches below grade, and no more than 48 <br /> Ordinance - 1 <br />
