However, this is what I believe is <br /> going on. <br /> What we have here is a PUD (I think Terry Jones is lead) in which the developer (Cuddeback) is very closely <br /> following the letter of law in getting trees removed from the conservation zone by having a certified arborist <br /> evaluate and declare the trees hazardous. My understanding is that even though a tree is in a conservation <br /> zone, if it is clearly hazardous to the neighboring property or homes being constructed, then it can be removed. <br /> There have been a series of removal requests, each evaluated and each granted. I think there is another one <br /> which Planning received on May 28th and forwarded to our office for comment ( still being processed, but is <br /> likely to be recommended for approval.) <br /> Since this is an active PUD it is not under the Tree Preservation Ordinance (6.300 6.330) so I believe the <br /> coordination of questions of abutting property needs to be preformed by the assigned Planning staff or LUMS <br /> (who have the anchorite on PUDS) with my staff providing consulting services to Planning on a per request <br /> basis. <br /> Jerry, I hope this meets with your approval and if the planning lead is TJ, perhaps she can contact the concemed <br /> neighbors. If a field meeting becomes necessary we can supply staff to discuss the specific hazardous tree <br /> issues through Planning. <br /> I will be out of my office most of today and all day tomorrow but will try to get back to any E -MAIL .
