The new ordinance also establishes an appeal process similar to that used <br /> in the variance process. According to PIC staff the average cost of appeals <br /> for land use decisions had been approximately $ 1,200. Considering that <br /> these may be simpler than land use decisions a typical billing to the City <br /> from the Hearings Official is expected to be in the range of $ 400 - $ 500. <br /> Estimating four hours of staff time to be included with the cost of the Hear- <br /> ing Official could result in an appeal fee generating full cost recovery to <br /> be $ 600 - $ 700. The code would allow the the Hearings Official the right <br /> to refund all or part of this fee if their appeal was successful. <br /> Considering the emotional nature of some appeals and complaints received, and <br /> that the ordinance allows anyone who wishes to participate in the process the <br /> right of appeal, staff would be swamped unless the cost of the appeal prohib- <br /> ited frivolous appeals. <br /> 7/2/93 jrm <br />
