The violation can briefly be described as removal of five trees from the <br /> property without a permit. <br /> This Notice of Civil Penalty is issued without prior written notice to correct the violation on <br /> the basis that the violation is complete and not capable of correction. <br /> You may request a hearing by filing a notice of appeal at the Permit and Information <br /> Center, 244 East Broadway, Eugene, OR 97401, within 15 days of the date of this letter. <br /> The notice of appeal must be completed, signed and accompanied by an appeal fee of <br /> $100.00. The appeal is not effective until all of these requirements have been completed. <br /> You may appeal the imposition of these civil penalties, including the determination that a <br /> violation exists, that you are a responsible party, or the amount of the penalty. Unless the <br /> City receives your request for a hearing within 15 days of the date of this letter, you waive <br /> your right to a hearing. <br /> A civil penalty becomes final upon the expiration of the time for filing an .appeal, if an <br /> appeal is not filed.
