On the northwestern property (Tax Lot 18-03- <br /> 03-23- 00400), the center of the Privately Engineered Public Improvement (PEPI) proposed Right -Of- <br /> Way(R.O.W.) was marked as were the required cut lines. Less than five trees had been removed from <br /> outside the proposed R.O.W. on this tax lot. <br /> On the property that is lower and to the southeast(Tax Lot 18- 03- 03- 20- 01100), the center of the proposed <br /> R.O.W. had been marked. No apparent tree removal had occurred near the proposed R.O.W., although <br /> Mr. Ansola stated that his long term plans did include removal of trees from the R.O.W. Tree felling has <br /> occurred on the area of the southeast corner of the tax lot. Mr. Ansola said he had some of these trees <br /> felled from the adjacent tax lot (18- 03- 03 -20- 01200). Without a formal survey to mark the property lines, <br /> it could not be accurately determined during this visit whether or not that was the case. (A site visit on <br /> 7/16/99 determined that Tax Lot 18- 03 -03 -20 -01200 was indeed involved, but that only one tree had been <br /> felled on that tax lot.) Mr. Ansola discussed his reasons for removing the trees that had been felled. After <br /> other City staff had looked at and discussed the areas of their concern, Molly Ritter stated that no further <br /> action of any sort on the site was authorized at this time, and all City staff except Urban Forestry staff left <br /> the site. Urban Forestry staff invited Mr. Ansola and Mr. Baxter to participate in or watch the <br /> measurement of the trees that had been felled. They declined at that point in time but later returned to <br /> watch a few measurements. <br /> Twenty nine trees were measured that had been stacked (decked) at the site. In addition, four unstacked <br /> trees that had been cut were measured. Tree diameters were taken at true dbh (diameter breast high which <br /> is 4.5 feet above ground) when the trunk was still attached to the root, or where a relationship could be <br /> unquestionably established between a trunk and stump. Otherwise, the diameter was taken 4.5 feet from <br /> the butt end of the log. This conservative measurement of tree diameter was used to remove any question <br /> of whether or not the woody stem was eight inches or greater at 4.5 feet (see the definition of a "tree" in <br /> Eugene Code 6.300). Observations by Urban Forestry staff on 7/6/99 led to the conclusion that all of these <br /> trees had been alive at the time of cutting (green needles or leaves on branches attached to trunks or shiny <br /> appearance of the inner bark). <br />
