September 15, 2004
Mark Snyder
Urban Forester
Eugene Parks & Open Space
1820 Roosevelt Blvd
Eugene OR 97402
Dear Mr. Snyder,
Your brief note in response to my letter and the second draft of the Street Tree Agreement did not address
all of my issues. I am still working under the assumption that you have the authority to negotiate a Street
Tree Agreement and that Arlie & Company is not applying for just a Street Tree Planting Permit.
As a party to this agreement, there are some elements that Arlie & Company is not willing to eliminate
from the agreement. They are:
1. The city's responsibility for the existing street trees should be clearly identified in this agreement.
2. The tree spacing is part of a well thought out streetscape along a commercial shopping street.
This project is not a single - family subdivision. Arlie & Company has accepted that the utility
crossing, utility volts, valve boxes, street lights, etc conflicts and there may have to be less trees.
However, we are not willing to add more trees for obvious reasons.
In addition, you did not respond to the Design Team's original idea of giving the city a public street
sidewalk easement behind the Crescent Avenue right -of -way for a more gracious landscape parkway
along the north side of Crescent Avenue. Did you meet with the appropriate city staff to discuss this
issue? I am still curious as to why the sidewalk easement idea was not acceptable for a public sidewalk.
If you do not have the authority to raise this issue with Public Works operation and maintenance works
sections, I can raise this issue with Kurt Corey, the Director of Public Works.
I am willing to have a meeting with you and other members of city staff to continue this negotiation. If
you have any questions, please do not hesitate to contact me at 344 -5500.
/ E" ---- 7 41Y
Sincere„ ,
L • it, ' .
