Forister, <br /> Per the above agreement with the City of Eugene and myself, this Housing Development <br /> should now have a total of 72 trees planted. I had prepaid for these trees with my check of <br /> $23,760.00 dated June 21, 1999 which was at a cost of $330.00 per tree. A copy of this check is <br /> enclosed. <br /> To date the City has planted 37 trees and I have planted 2 at my own expense. I have <br /> several homeowners who purchased their houses under the agreement that the city was to plant <br /> trees within a designated time frame. That time frame has long past. <br /> Please be advised that I am now giving the city 30 days to either comply with the original <br /> agreement and plant the remaining 33 trees and reimburse me $660.00 for the two I planted, or <br /> reimburse me for the 33 unplanted trees plus the two I planted for a total of $11,550.00. <br /> If you find that my figures are not correct I can be reached during the day at 541 -689- <br /> 4154, otherwise I expect to have this matter resolved by the city by February 27, 2004.
