NOTICE OF STREET TREE AGREEMENT <br /> KNOW ALL BY THESE PERSONS: That Rodney Kempf., hereinafter referred to as "Developer" and <br /> the City of Eugene, a municipal corporation of the State of Oregon, hereinafter referred to as "City," have <br /> entered into an agreement governing the purchase, installation and establishment of street trees, granted in <br /> accordance with Eugene Code Sections 2.019 and 7.280, adopted Administrative Rule R- 7.280, a copy of <br /> which is filed with this agreement in the City Recorder's Office. Eugene Code Section 7.280 and the Rule <br /> specify that approval of a development that involves the creation of a street shall not be granted unless the <br /> applicant has submitted and received approval of a Street Tree Plan or executed an agreement with the <br /> City to ensure that street trees will be planted and established in accordance with City standards, rules, <br /> procedures and policies. The Street Tree Plan is referenced in the agreement as Exhibit "C," and is filed <br /> with the agreement in the City Recorder's Office. This street tree agreement was granted to allow <br /> purchase, installation and establishment of street trees in Robbie Park, a legal description of which is <br /> attached as Exhibit "A ". <br /> The use and development of the above property is governed by the terms and conditions of that Street Tree <br /> Agreement and the attached plans and specifications made by and between said parties on the above date. <br /> Said Agreement and the approved plans are recorded in the City of Eugene City Recorder's Office, and to <br /> which reference is hereby made for all matters and things therein contained. <br /> IN WITNESS WHEREOF, the parties hereto have set their hand and seal this day of <br /> ,19 <br /> DEVELO ' ' - Rodney Kempf State of OREGON <br /> County of Lane - <br /> B , = ���� ���,� �( —/C _?
