NOTICE OF STREET TREE AGREEMENT <br /> KNOW ALL BY THESE PERSONS: That Terra Buono Properties III, LLC, hereinafter referred to as <br /> "Developer" and the City of Eugene, a municipal corporation of the State of Oregon, hereinafter referred <br /> to as "City," have entered into an agreement governing the purchase, installation and establishment of <br /> street trees, granted in accordance with Eugene Code Sections 2.019 and 7.280, adopted Administrative <br /> Rule R- 7.280, a copy of which is filed with this agreement in the City Recorder's Office. Eugene Code <br /> Section 7.280 and the Rule specify that approval of a development that involves the creation of a street <br /> shall not be granted unless the applicant has submitted and received approval of a Street Tree Plan or <br /> executed an agreement with the City to ensure that street trees will be planted and established in <br /> accordance with City standards, rules, procedures and policies. The Street Tree Plan is referenced in the <br /> agreement as Exhibit "C," and is filed with the agreement in the City Recorder's Office. This street tree <br /> agreement was granted to allow purchase, installation and establishment of street trees in Crescent <br /> Meadows Fourth Addition, a legal description of which is attached as Exhibit "A ". <br /> The use and development of the above property is governed by the terms and conditions of that Street Tree <br /> Agreement and the attached plans and specifications made by and between said parties on the above date. <br /> Said Agreement and the approved plans are recorded in the City of Eugene City Recorder's Office, and to <br /> which reference is hereby made for all matters and things therein contained. <br /> ITNESS WHEREOF, the parties hereto have set their hand and seal this 9�day of <br /> 19 X 11. <br /> .
