INTERGOVERNMENTAL AGREEMENT FOR EXCHANGE OF REAL PROPERTY <br /> Patterson School Site <br /> PARTIES: 0 3 - 0 5 3 3 4 <br /> City of Eugene ( "City ") <br /> Eugene School District 4J ( "District ") <br /> RECITALS <br /> A. The parties are units of government who desire to enter into this Intergovernmental <br /> Agreement for Exchange of Real Property (this "Agreement ") pursuant to ORS Chapter 190. The <br /> provisions of ORS 190.020(1)(b) and (c) relating to apportionment of fees and transfer of personnel <br /> are inapplicable to this Agreement, and the remaining subsections, if applicable, are addressed in this <br /> Agreement. <br /> B. The District has passed a $116,000,000 bond that includes a development of a new <br /> elementary school near the site of the existing Patterson Elementary School, whereby the new <br /> elementary school shall consolidate and replace the current programs at the Patterson and <br /> Westmoreland Elementary Schools. <br /> C. The District has determined that, for a variety of reasons, the location of the new elementary <br /> school will be best established on a portion of a parcel of land adjacent to and just south of the <br /> existing Patterson Elementary School that is owned by the City. That portion of the City's land that <br /> the District seeks to obtain pursuant to this Agreement shall be referred to herein as the "School Site <br /> Parcel." <br /> D. The current site of the Patterson Elementary School contains undeveloped land to the west <br /> of the existing school with an area roughly equivalent in size to the size of the School Site Parcel. <br /> The District has offered to convey this portion of land (the "Exchange Parcel ") to the City in <br /> exchange for the School Site Parcel. <br /> E. The City -owned land that contains the School Site Parcel is currently improved with a <br /> softball and soccer field as a recreational facility for the public and primarily used by City residents <br /> who live near the School Site Parcel. <br /> F.
