INTERGOVERNMENTAL AGREEMENT <br />This Agreement is between the City of Eugene (City), and the River Road <br />Park and Recreation District (District). The purpose of this Agreement is to <br />memorialize understandings relating to City operation of facilities owned by <br />the District if the District is dissolved by annexation of its entire <br />territory to the City. As used in this Agreement, "Emerald Park Facilities" <br />means the existing facilities of the District and any future facilities <br />acquired prior to annexation. This Agreement is entered into pursuant to ORS <br />190.010. <br />RECITALS <br />A. The District was formed in 1954 and provides park and recreation <br />services to residents of the River Road area. Facilities operated by the <br />District are of high quality. Facilities located at Emerald Park include a <br />community center, an aquatic center, and a ten -acre park. Other facilities <br />operated by the District include the.Park District Annex (senior center) <br />Prairie Hall (gymnastics facility). <br />B. If annexation of the entire District occurs, ORS 222.510 provides <br />that the District will be extinguished and the City will succeed to the <br />assets, liabilities, obligations, and functions of the District. The District <br />seeks assurances that its investment in park facilities will be maintained and <br />that staffing and services will not decline as a result of such annexation. <br />C. This Agreement is made for the purpose of providing those assurances <br />to the extent allowed by law. Both parties recognize that the City may not <br />have lUaal authority to commit to financial expenditures beyond the current <br />fiscal year (Fiscal Year 1992 -93). No warranty of express or implied authority <br />of the City to perform the commitments stated below is given. Such obligations <br />INTERGOVERNMENTAL AGREEMENT - -1 <br />
