Motion to Dismiss <br />The City moves LUBA to dismiss LUBA No. 2006 -024 on the grounds that the <br />Petitioners have withdrawn their appeal of Ordinance No. 20362. <br />Petitioners appealed both Ordinance No. 20362 (LUBA No. 2006 -024) and Resolution <br />No. 4858 (LUBA No. 2006 -023) (Rec. 1 -6). At page 2, lines 2 -3 of their Petition for Review, <br />Petitioners "withdraw" their appeal of Ordinance No. 20362 (LUBA No. 2006 -024), stating: <br />"Petitioners hereby withdraws [sic] its appeal of the city's repeal of the 1989 Plan by Ordinance <br />No. 20362."
