from entering in or using all City of Eugene parks, open spaces or facilities until May, 25, 2012 ( "Notice "). <br />The stated basis for issuance of the Notice is a violation of EC 4.726, Harassment. On April 27, 2012, <br />Lauren Regan, on behalf of Ms. Bartow, appealed the Notice in accordance with POS Rules Section R -1.074 <br />and waived the 72 -hour hearing requirement. The appeal hearing was held on May 11, 2012. <br />At the appeal" hearing, Ms. Bartow stated that she was at the Park Blocks with her child and the child of her <br />domestic partner when she saw Officer Schulke handing out police stickers to the children. Officer Schulke <br />had already handod a sticker to her child and she saw him about to hand a sticker to her domestic partner's <br />child. According to Ms. Bartow, in an effort to slap away the hand of the child so that the child did not take <br />the sticker, she inadvertently made contact with Officer Schulke's hand. Ms. Bartow stated that she did not <br />intend to slap Officer Schulke. At the appeal hearing, Officer Schulke, reading from his police report, stated <br />that he was handing out police stickers to some children when Ms. Bartow ran toward him aggressively and <br />slapped his hand very hard. Officer Schulke stated that the aggressive actions of Ms. Bartow appeared to <br />frighten the children that were watching. The harassment charge against Ms. Bartow was for slapping Officer <br />Schulke's hand. <br />Decision <br />It is uncontested that on April 25, 2012, Ms. Bartow was arrested for harassment (along with other charges) <br />for an incident that occurred at the Park Blocks. Pursuant to POS Rules R- 1.005(3)(a), because Ms. Bartow <br />engaged in conduct in a park that resulted in her being arrested by a police officer for violating the Eugene <br />Code, Officer Schulke had the authority to issue Ms. Bartow a Notice of Restriction of Use. As issued, the <br />Notice prohibits Ms. Bartow from entering or using all Cit of f Euge, ne parks open spaces or facilities until <br />May 25, 2012. Based on the testimony provided at the appeal hearing and the stated basis for the Notice, I <br />hereby MODIFY the scope of the Notice to prohibit Ms. Bartow from entering or using the Park Blocks <br />until May 25, 2012. <br />Jo y Medlin <br />Director, Parks and Open Space <br />Cc: Lauren Regan, CLDC <br />Officer Shulke, EPD <br />
