hand a sticker to her domestic partner's child. According to Ms. Bartow, in an effort to slap <br />away the hand of the child so that the child did not take the sticker, she inadvertently made <br />contact with Officer Schulke's hand. Ms. Bartow stated that she did not intend to slap Officer <br />Schulke. At the appeal hearing, Officer Schulke, reading from his police report, stated that he <br />was handing out police stickers to some children when Ms. Bartow ran toward him aggressively <br />and slapped his hand very hard. Officer Schulke stated that the aggressive actions of Ms. Bartow <br />appeared to frighten the children that were watching. The harassment charge against Ms. Bartow <br />was for slapping Officer Schulke's hand. <br />Tleci 6 nn <br />It is uncontested that on April 25, 2012, Ms. Bartow was arrested for harassment (along with <br />other charges) for an incident that occurred at the Park Blocks. Pursuant to POS Rules R- <br />1.005(3)(a), because Ms. Bartow engaged in conduct in a park that resulted in her being arrested <br />by a police officer for violating the Eugene Code, Officer Schulke had the authority to issue Ms. <br />Bartow a Notice of Restriction of Use. As issued, the Notice prohibits Ms. Bartow from entering <br />or using all City of Eugene parks, open spaces or facilities until May 25, 2012. Based on the <br />testimony provided at the appeal hearing and the stated basis for the Notice, I hereby MODIFY <br />the scope of the Notice to prohibit Ms. Bartow from entering or using the Park Blocks until May <br />25, 2012. <br />
