Should Eugene Code be modified to allow this practice? <br />ADDITIONAL BACKGROUND <br />On recent review of Eugene Code, the City attorney questioned the legitimacy of a former staff member <br />allowing private citizens to be in city parks after hours for park- related activities. The attorney's opinion <br />was that the authority to allow anyone other than city staff to be in a city park after hours had never been <br />delegated to the City Manager by the City Council. In light of this interpretation, a number of past and <br />current practices are not in compliance. <br />In summary, Eugene Code 4.680 states that no person shall be in a city park between the hours of 1 I <br />p.m. and 6 a.m., unless they are driving through the park on lawful business or individually authorized <br />by the City Council. <br />Some examples of current and past practices where people have been allowed in parks after hours <br />include: <br />a.
