August 12 - Public Hearing - Park after hours ordinance <br />Tonight we are asking the Council to hold a Public Hearing and take <br />action on a proposed ordinance which delegates to the City Manager <br />the authority to authorize people to be in a park between the hours <br />of 11:00 p.m. and 6:00 a.m. of the succeeding day. <br />The past practice has been for the City Council to review and take <br />action on any requested change to the hours in which a park would <br />be open to the public. <br />�50 <br />The City Manager has authorized private people to be within parks <br />after hours if their purpose for being there is to perform activities <br />that are in support of park activities which are to occur during open <br />hours. <br />he ity Attorney has indicated that the authority to allow anyone <br />other than city staff to be in a park after hours has never been <br />delegated to the City Manager by the City Council. <br />In light of this interpretation, a number of past and current <br />practices are not in compliance with the code. <br />Examples include: <br />• People associated with the operation of WISTEC <br />�• Clean -up and take down after Cuthbert events <br />• Current Morse Ranch custodians /hosts living on site <br />• Current park hosts at Alton Baker Pa rk living on site <br />• Past contracted custodians hired to clean park restrooms after <br />park closure <br />• Proposed park host at Skinner Butte Par --- SP"nf�'6 <br />Private security guards, hired by event sponsors for multi -day <br />Q� special events, who patrol vendor areas after hours. <br />
