ADMINISTRATIVE ORDER NO. `gig `9 3 i <br />of the <br />City Manager of the City of Eugene <br />ESMI ISHIIQG PARK AND FACIIM USE FEE SCHEDULL— <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.010 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br />13. In accordance with the procedures set forth therein, on April 21, 1993 I <br />notified the Mayor and City Council that I intended to increase the currently effective park <br />and facility use fee schedules. The Notice was also published in the Register Guard on April <br />25, 1993, posted at two locations at City Hall on April 21, 1993, and made available for <br />inspection by interested persons at the offices of the City's Parks, Library and Cultural <br />Services Department, 22 West 8th Avenue, Eugene, Oregon 97401. The Notice provided <br />that written comments would be received thereon for a period of 15 days from the first date <br />of publication and posting. <br />C. Three written responses were received, raising the following objections, to <br />which I make the following specific findings: <br />Objection i ; One response objected to the raising of any fees, with no specific <br />objections to the fees proposed in the notice. <br />Findin . The general findings set forth below are responsive to this non- <br />specific objection. <br />Objections 2 and 3 : These two responses expressed concern with the amounts <br />charged for commercial video and film- making in the parks, asserting that the fees <br />effectively prevented use by a commercial film - maker, other than those with multi- <br />million dollar budgets. <br />Finding The Parks Maintenance Superintendent met with representatives of <br />the two companies submitting this objection, with a representative from the <br />University of Oregon present as a facilitator. As a result, an alternative "stepped" <br />approach to the commercial video and film - making use fee was developed, which has <br />been incorporated in the fee schedule attached hereto. <br />D. In addition to the specific findings above, I find that the fees set forth in <br />Exhi bit A .. ere t o are consistent with applicable policies and directives of the City Council, <br />including strategies developed through the Eugene Decisions process; comparable to the fees <br />established in other jurisdictions for similar services; and are necessary in order to comply <br />with the CouncWs goal of recovering the cost of providing such services from the <br />Administrative Order - 1 <br />
